Welcome to Career Power Pack™, a service provided by Achaibo Clinical ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Career Power Pack provides AI-powered career acceleration tools designed for healthcare and life science professionals. Our Service includes:

• Resume optimization and ATS-friendly rewriting
• LinkedIn profile enhancement with keyword optimization
• Cover letter generation tailored to specific roles
• Personalized 12-month career roadmap planning
• Interview simulation and preparation (Expand plan only)
• Salary negotiation guidance and data (Expand plan only)

We offer two subscription tiers: Evolve ($14.99/month) and Expand ($49/month or $490/year). The specific features available to you depend on your chosen subscription plan.

3. User Accounts and Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use our Service. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Payment Terms

4.1 Subscription Fees

Access to Career Power Pack requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan. All payments are processed securely through Stripe, our third-party payment processor.

4.2 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method on file for the renewal fee. We will provide reasonable notice before charging your payment method for renewal.

4.3 Price Changes

We reserve the right to modify subscription fees at any time. We will provide you with at least 30 days' notice before any price increase takes effect. Your continued use of the Service after the price change constitutes your agreement to pay the modified fees.

4.4 Taxes

All fees are exclusive of applicable federal, state, local, or foreign taxes. You are responsible for paying all taxes associated with your purchase, except for taxes based on our net income.

5. Cancellation and Refunds

5.1 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Cancellation will take effect at the end of your current billing period, and you will retain access to the Service until that date.

5.2 Refund Policy

We offer a 14-day money-back guarantee for first-time subscribers. If you are not satisfied with our Service, you may request a full refund within 14 days of your initial purchase. After the 14-day period, subscription fees are non-refundable, and no refunds or credits will be provided for partial months or unused portions of the Service.

5.3 Refund Requests

To request a refund, contact us at [email protected] with your account information and reason for the refund. Refunds will be processed within 5-10 business days to your original payment method.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Share your account credentials or allow others to access your account
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use automated systems (bots, scrapers) to access the Service without our permission
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Remove, obscure, or alter any proprietary notices on the Service
• Use the Service to create competing products or services

Violation of these acceptable use terms may result in immediate termination of your account and access to the Service.

7. Intellectual Property Rights

7.1 Our Content

The Service and all content, features, and functionality (including but not limited to text, graphics, logos, software, and AI-generated content) are owned by Achaibo Clinical or our licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of any content you submit to the Service (such as your resume, LinkedIn profile, or career information). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your content solely to provide and improve the Service.

7.3 AI-Generated Content

Content generated by our AI tools (such as optimized resumes or cover letters) is provided to you for your personal use. You are free to use, modify, and distribute AI-generated content as you see fit. However, we make no warranties regarding the accuracy, completeness, or suitability of AI-generated content for any particular purpose.

8. Disclaimers and Limitations of Liability

8.1 No Guarantee of Results

Career Power Pack provides tools and guidance to support your career development. However, we do not guarantee specific outcomes, such as job offers, salary increases, or career advancement. Your success depends on many factors beyond our control, including your qualifications, effort, market conditions, and employer decisions.

8.2 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACHAIBO CLINICAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; (C) ANY ERRORS OR OMISSIONS IN ANY CONTENT; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Achaibo Clinical and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Service will immediately cease.

All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree to waive any right to a jury trial or to participate in a class action lawsuit. Any arbitration shall be conducted on an individual basis and not as a class or representative action.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Effective Date" at the top. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely matches the intent of the original provision.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Achaibo Clinical regarding the Service and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter herein.
